The MBYBC’s request for review was heard in the Western Cape High Court in Cape Town on 2 March 2018.
The Commodore attended the hearing and came back feeling positive about our case.
Our Advocate presented a good case which was, in our opinion, well received by the judges. The Judges will now consider all information placed before them before handing down their judgement.
This will not happen immediately – it can in fact take up to a year. We will keep you posted on any further developments.
In the meantime the MBYBC is the legal tenant of the property on a month to month basis and this will remain the position until the process is completed.
Some of you may have heard that Algoa Bay Yacht Club has been evicted and this is indeed true. It is important though to note that their case is totally different from ours as ABYC did not pay their full rental and were thus regarded as defaulters. MBYBC on the other hand have been paying their rent diligently and are good tenants without any blemish.
The club is in a good place right now and we are gaining many new members. The Transformation projects are also going well. We again want to appeal to all members to please support the club so the MBYBC will continue to grow from strength to strength.
